Welcome to IP Flare! These Terms of Service ("Terms") are between you and SOCIAL FREAK LTD ("we," "us," or "our"), and govern your use of our IP Geolocation API and any related services (collectively, the "Services").

We strive to provide accurate geolocation data; however, we do not guarantee the precision or reliability of the data provided. Geolocation via IP address has inherent limitations and may not always be current or accurate. You acknowledge that the Services should not be used to identify a specific household, individual, or street address.

9. Disclaimers

The Services are provided "as is" and "as available." We disclaim all warranties, express or implied, including warranties of merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that the Services will be uninterrupted, secure, or error-free.

10. Limitation of Liability

To the fullest extent permitted by law, we will not be liable for any indirect, incidental, special, consequential, or exemplary damages arising from your use of the Services. Our total liability to you for all claims arising from or related to the Services shall not exceed the amount you have paid us in the past six months or £100, whichever is greater.

11. Indemnification

You agree to indemnify, defend, and hold harmless SOCIAL FREAK LTD and its affiliates, officers, directors, employees, agents, and licensors from any claims, damages, liabilities, and expenses arising from your use of the Services or violation of these Terms.

Any disputes arising from these Terms or the Services will be resolved through binding arbitration in accordance with the Arbitration Act 1996. The seat of arbitration shall be London, UK. You and we agree to waive any right to participate in a class-action lawsuit or class-wide arbitration.

21. Feedback

If you provide us with any feedback or suggestions regarding the Services, you grant us a non-exclusive, worldwide, royalty-free license to use and incorporate such feedback into the Services.

22. API Keys and Access

To access our Services, you may be required to obtain an API key. You are responsible for safeguarding your API key and preventing unauthorized use. You agree not to share your API key with any third party. SOCIAL FREAK LTD is not liable for any loss or damage arising from your failure to protect your API key. If you suspect any unauthorized use of your API key, you must notify us immediately.

23. Usage Limits and Rate Limiting

We may impose limits on the number of requests you can make to the Services within a specified time period. These limits are designed to ensure the stability and reliability of the Services for all users. Exceeding these limits may result in temporary or permanent suspension of your access to the Services. We reserve the right to modify these usage limits at any time.

We may provide support services for the Services at our discretion. Any support provided is subject to these Terms and our policies. We are not obligated to provide any specific level of support and may change or discontinue support services at any time without notice.

25. Versioning and Changes to API

We may update or modify the API and related Services from time to time, including introducing new versions or deprecating existing ones. We will provide reasonable notice of significant changes or deprecations. It is your responsibility to update your integrations to remain compatible with the latest versions of the API. Failure to do so may result in reduced functionality or termination of access.

26. Prohibited Activities

In addition to the restrictions outlined in Section 5, you agree not to:

  1. Attempt to gain unauthorized access to any portion of the Services, other user accounts, or computer systems.
  2. Use the Services to collect or harvest personal data about other users.
  3. Impersonate any person or entity or misrepresent your affiliation with a person or entity.

27. Reverse Engineering

You agree not to reverse engineer, decompile, disassemble, or otherwise attempt to discover the source code or underlying structure of the Services, except to the extent that such activity is expressly permitted by applicable law.

You agree to comply with all applicable export laws and regulations of your country, as well as any other applicable export laws and regulations of the United Kingdom. You may not export or re-export any data or technical information obtained from the Services in violation of any such laws or regulations.
